Seller and scope

The GlucoLamp online store at glucolamp.com is operated by Modulate IT d.o.o., Bobovje 52G, 49000 Krapina, Croatia, company ID (OIB) 08273636899, VAT ID HR08273636899, info@glucolamp.com. “We”, “us” and “GlucoLamp” mean Modulate IT d.o.o.; “customer” means a store user or purchaser.

These Terms govern store use, ordering, payment, delivery and product use. By ordering, customers confirm they had an opportunity to read these Terms and the Refund, Shipping and Privacy Policies. Mandatory consumer rights in the country of habitual residence remain unaffected.

Product, safety and compatibility

GlucoLamp is an ambient device displaying glucose data from a compatible third-party system or service. It is not a medical device, does not measure glucose or diagnose, and does not replace a certified receiver, app, alarm, medical advice or emergency care. Never base treatment, insulin, diet or emergency decisions solely on its display; verify data in the official CGM app/device and follow healthcare advice.

The product works only with systems, devices, accounts, internet connections and services expressly listed as supported on the product page or in current instructions. Customers must check requirements and compatibility before purchase. Operation may depend on the internet, local network, CGM and third-party services, including supported Dexcom, FreeStyle Libre and Nightscout integrations. Their names and marks belong to their owners; we are not affiliated with them or in control of their services unless expressly stated.

We do not guarantee uninterrupted third-party services and are not liable for their outages, delays, API changes, discontinued functions or inaccurate external data beyond our reasonable control. This does not exclude liability where, for reasons attributable to us, the product fails to conform to the contract, description or advertised compatibility.

Use the product according to instructions and warnings. Unauthorised modifications, unsuitable power, water, heat or improper conditions may cause failure or danger. Customers must secure accounts, credentials and networks. We do not request CGM account credentials by email; do not email them to us.

Orders, prices and payment

A product listing is an invitation to purchase. Customers may correct details before placing an order; submitting an order with an obligation to pay is an offer. An automated receipt is not necessarily acceptance; the contract forms when we confirm acceptance or dispatch, whichever comes first. We may reject or cancel for unavailability, an obvious pricing error, suspected fraud, shipping restrictions or another justified reason and promptly refund sums paid. Customers must provide accurate details and have legal capacity to contract.

Prices use the selected currency and include VAT where required. The final price, payment methods and extra charges appear before ordering. Purchases are one-off, without subscriptions unless expressly disclosed before payment. Authorised payment providers process payments under their terms. We may reject an obviously incorrect price and refund it; we will not increase an accepted order’s price without consent.

Delivery, conformity and warranties

The Shipping Policy states areas and estimates. Risk passes when the consumer or their nominated person, other than the carrier, receives the product, except where the consumer independently chose a carrier we did not offer.

Consumers have statutory remedies for nonconforming goods, including seller liability for defects for at least two years after delivery. Subject to law, they may request repair or replacement and, if impossible or not completed within a reasonable time without significant inconvenience, a price reduction or termination. Any commercial warranty is additional and cannot reduce statutory rights. Normal wear or damage caused by misuse, accident or unauthorised modification is not itself a seller defect.

Intellectual property and acceptable use

The site, GlucoLamp name, design, images, text, graphics, software and documentation are protected rights of Modulate IT d.o.o. or relevant owners. Customers receive a limited, non-exclusive right for personal, lawful use. Reproduction, distribution, sale, rental, unauthorised modification or commercial exploitation is prohibited without permission, except as mandatory law allows.

Illegal acts, unauthorised access, interference with security or operation, malicious code, unlawful automated collection and infringement of others’ rights are prohibited. Serious or repeated breaches may result in restricted access without affecting existing statutory contractual rights.

Liability, force majeure and disputes

We are liable as required by applicable law. Nothing excludes liability that cannot lawfully be excluded, particularly for intent or gross negligence, death or personal injury, defective products or statutory consumer rights. To the lawful extent, we are not liable for loss caused solely by circumstances beyond reasonable control, misuse, incompatibility clearly disclosed before purchase or third-party service failure; nonconformity rights remain.

We are not responsible for delay or non-performance caused by unforeseeable, unavoidable events such as major transport disruption, natural disaster, war, epidemic, infrastructure failure or government action. We will notify customers; if performance becomes impossible, we refund the undelivered product.

Written complaints may be sent to info@glucolamp.com or the seller’s address. We acknowledge promptly and respond in writing within 15 days, stating whether the complaint is accepted. We seek an amicable solution; consumers may use a competent alternative dispute resolution body. Croatian law applies without removing mandatory protection under the consumer’s habitual-residence law; jurisdiction follows applicable law.

The Terms in force when an order is submitted govern it. Changes apply to future use and orders. Questions: info@glucolamp.com.
